‘Move over’ law

(8/14/2019)

When writing on the need to move over to the right lane while driving, Sgt. Christianson states in his letter to the Post, published on August 11, 2019, “Nothing allows a driver to exceed the speed limit. The posted speed limit is the law.” This is not correct. Minnesota Statute 169.14, subd. 2, states, “Increased speed limit when passing … the speed limit is increased by ten miles per hour over the posted speed limit,” providing the speed limit is 55 mph on a two-lane, two-way highway. Granted this is not the situation that the sergeant is talking about (a four-lane highway with two-lanes in each direction). However the sergeant’s statement as quoted above is not correct in all circumstances and needs clarification.
