THIS STATE OF MINNESOTA TO THE ABOVE NAMED DEFENDANTS:
You are hereby summoned and required to serve upon Plaintiffs’ attorney an Answer to the Complaint which is herewith served upon you and which is on file in the Office of the Court Administrator of the above named Court within twenty (20) days after service of this Summons upon you, exclusive of the day of service. If you fail to do so, judgment by default will be taken against you for the relief demanded in the Complaint.
This action involves, affects or brings in question real property situated in the County of Winona, State of Minnesota, described as follows:
See Exhibit “A” attached hereto and made a part hereof.
That part of Lots 11, 14, and 16, Plat of the Subdivision of the Town of Wilson, Section 35, according to the recorded plat thereof, Winona County, Minnesota, being located upon and forming a part of the Southeast Quarter of the Southeast Quarter of Section 35, Township 106 North, Range 7 West, said Winona County, described as follows:
Commencing at the southeast corner of said Section 35; thence North 00 degrees 03 minutes 57 seconds East (Note: all bearings are based on the Winona County Coordinate System NAD83 Adj. 1996) along the east line of the Southeast Quarter of said Section 35 for a distance of 655.41 feet; thence North 89 degrees 22 minutes 01 seconds West for a distance of 214.92 feet to the POINT OF BEGINNING; thence North 19 degrees 21 minutes 03 seconds West for a distance of 25.25 feet; thence North 79 degrees 26 minutes 39 seconds West for a distance of 113.24 feet; thence South 63 degrees 19 minutes 57 seconds West for a distance of 51.80 feet; thence South 62 degrees 28 minutes 27 seconds West for a distance of 76.76 feet to the former centerline of former Trunk Highway No. 76; thence South 34 degrees 33 minutes 15 seconds East along said former centerline for a distance of 125.34 feet to the intersection of a line bearing South 54 degrees 13 minutes 57 seconds West from the Point of Beginning; thence North 54 degrees 13 minutes 57 seconds East along said last intersected line for a distance of 200.84 feet to the Point of Beginning.
Said Parcel is subject to the right of way easement of County Road No. 12. Said Parcel is also subject to any other easements or encumbrances of record.
The object of this action is to determine that the Defendants have no right, title, estate, interest or lien in or on the above-described real property.
NOTICE OF NO
No personal claim is made against any of the Defendants in the action above-entitled.
You are further informed that this matter may be subject to Alternative Dispute Resolution (ADR) processes under Rule 114 of the Minnesota General Rules of Practice for the District Courts. The Court Administrator or your attorney can provide you with information about ADR processes available and a list of neutrals who provide ADR services. ADR does not, however, affect your obligation to respond to the Complaint within the above-stated time period.
