A lawsuit filed in October 2010 by former four-year Winona Area School Board member Stacey Mounce Arnold against the Winona Post is scheduled for trial in late January, 2013, after the Minnesota Court of Appeals declined to overturn a District Court ruling on the case.
Arnold’s suit claims the Winona Post defamed her in four articles and one editorial published during her tenure on the school board. A motion to dismiss the case was denied by Judge Jeffrey Thompson in August, 2012. In Judge Thompson’s opinion on the ruling, he wrote that the court had not heard from the relevant witnesses and has examined only a limited number of relevant exhibits. “This Court offers no opinion, and makes no determination, as to any of the facts that should be decided by a jury,” he wrote, adding that the issues in the case warrant examination by a jury.
The trial is scheduled for January 28, 2013.
