Winona man fires warning shot (04/03/2013)

A Winona man is facing charges after allegedly firing a drunken warning shot at strangers he says threatened to kill him. At 1:23 a.m. officers arrested Travis Jeffrey Brierley, 24, for felony reckless operation of a firearm, reckless discharge of a firearm, and reckless discharge of a firearm with an alcohol content over .10 percent. According to the report, Brierley was entering his residence on the 800 block of West Fifth Street when he started talking with two male strangers walking on the sidewalk. Brierley told police that the men threatened to kill him and said they had a gun. Brierley said that he then removed his .45 caliber pistol and fired a “warning shot” into the ground. The men left. Brierley called police to report the incident. When officers came and spoke with Brierley, they noticed a smell of alcohol on his person. A preliminary breath test indicated Brierley had a blood alcohol content of .16 percent. Brierley was in custody at the time of the report. He does have a valid concealed carry permit. No other parties made complaints following the gunshot.
