Charges follow DWI, drug arrest (05/05/2013)

Robert James Cerney, 32, of Winona, broke a lot of laws, police say. Cerney is being referred for first-degree driving while intoxicated, second-degree test refusal, fifth-degree possession of a controlled substance, possession of a small amount of marijuana, violation of a restricted driver’s license, driving left of center, no seat belt, no proof of insurance, and unsafe change of course. A passenger in his vehicle was ticketed for not wearing a seatbelt.

Winona Police officers stopped Cerney after they noticed his vehicle make a wild turn at Sugar Loaf Road and East Lake Boulevard at 1:06 a.m. on May 3. Officers impounded the vehicle because of the lack of insurance. As is routine with impounded vehicles, the car was searched and officers found five glass pipes, a bag of marijuana weighing 6.16 grams, five 5 milligram hydrocodone pills, and a small bag of .89 grams of white powder that field tested positive for cocaine, according to the report. A preliminary breath test indicated that Cerney’s blood alcohol content was .11 percent. Cerney is being charged with first-degree driving while intoxicated because of prior charges, and a restriction on his license that prohibits drug and alcohol use, police said. Cerney was arrested and was in custody at the time of printing.
