NOTICE AND ORDER OF HEARING ON PETITION FOR FORMAL PROBATE OF WILL PREVIOUSLY PROBATED INFORMALLY AND FOR OTHER RELIEF
NOTICE IS HEREBY GIVEN that a Petition for Formal Probate of Will Previously Probated Informally and for Other Relief signed by Shirley T. Stiehm ("Petition") has been filed with the Court.
Any objections to the Petition must be filed with the Court prior to or raised at the hearing. If proper and if no objections are filed or raised the Petition may be granted.
IT IS ORDERED, that the Petition will be heard on October 26, 2004, at 1:45 p.m., by this Court at Courtroom 3, Winona County Courthouse, 171 West Third Street, Winona, Minnesota.
1. Notice shall be given to:
a. All interested persons (Minn. Stat. ยง524.1-401) and persons who have filed a demand for notice pursuant to Minn. Stat. ยง524.3-204; and

2. Notice need not be given to John D. Michaels, Sr., father of the Decedent, for as evidenced by the file herein, said John D. Michaels, Sr. is not named as a devisee in the Decedent's Last Will and Testament dated May 6, 1998 and it is not known if said John D. Michaels, Sr. is alive or deceased and, if alive, where he may be located.
Additionally, as evidenced by the Affidavit of Publication on file herein, Notice of Informal Probate of Will and Appointment of Personal Representative, and Notice of Creditors was duly published and no response of any kind to the same was received from said John D. Michaels, Sr.
3. Notice shall be given by:
"ข Mailing a copy of the Petition and this Notice and Order by U.S. Postal Service at least 14 days prior to the hearing date.
"ข Publishing this Notice and Order in accordance with law.
