BOARD OF ADJUSTMENT
NOTICE OF HEARING
PLEASE TAKE NOTICE:
The following applications have been made for variations from the requirements of the Winona City Code, as listed below:
a. George Robert Leifeld - for variance of Section 43.32(b) (non conforming uses) which requires that no existing building or premises devoted to a use not permitted by this chapter in the district in which such building or premises is located except when required to do so by law or order, shall be enlarged, extended, reconstructed, substituted or structurally altered, unless the use thereof is changed to a use permitted in the district in which such building or premises is located; Section 43.20(b) which requires that the wall of accessory structures, located on lots of record, be setback a distance of three feet from side yard property lines, and that the setbacks to roof eaves be not less than two feet from any side yard property lines, and Section 43.52(c) which requires that accessory structures be setback a minimum of 60 feet from any front property line.
Petitioner owns a lot which includes one free standing accessory structure and is used for parking and storage purposes. Since the property does not include a dwelling, the current structure (and use thereof) is classified as "nonconforming". Petitioner desires to remove and reconstruct the front (westerly) 50 feet of the structure. Walls of the reconstructed structure will be 0 feet from the northerly side lot line a minimum of 1' 0" from the southerly side lot line, and a minimum of 3' 0" from the front (westerly) lot line. Property described as R-2, Lot 4 Blk 7 Ex Par Beg At Sw Cor Lot 4 E 69' N 27' Nw 81.25' To Pt 71' N Of Beg S 71' To Beg & Part Of Vacated Alley Between Wilsie & Rr Ex: Parcel 12' X 27' Com 69' East Of Sw Corner Lot 4, Bolcoms Addition, Or At 450 Wilsie Street.
a. Michael Slaggie - for variance of Section 43.55(e), which limits the height of accessory structures to one story and 15 feet in height. Petitioner wants to build a 22 _ foot high two story garage. Property described as R-1, Frac Lot 22 & All Lots 2,3,6,7,10,11 Blk 31 Ex Wly 80' Of Lots 2,3,6,7,10, 11 Blk 31 & Ex 125' X 81.32' Lot 22, Lakeview/02 Addition, or at 216 Lake Park Drive.
b. Polish Cultural Institute - for variance of Section 43.62(g), which requires a 25-foot front yard setback and a 30-foot rear yard setback, also Section 43.36 requires 40 off-street parking spaces. Petitioner wants to construct a new building with a front yard setback of 20 feet to the wall and 9 feet to the entrance canopy and a rear yard setback of 22 feet to the entrance canopy. Petitioner can supply 7 off-street parking spaces. Property described as M-1, W 1/2 Lot 3 & All Lot 4 Blk 7, Lairds Addition, or at 363 East Second Street.
c. Carol & Paul Schumacher - for variance of Section 43.52(b), which requires primary structures be set back from side street lot lines _ the required front yard setback or 12_ feet. Owner wants to add on to the garage with a 6_ foot side street setback. Property described as R-1, Lot 22, Block 1, Skyline Subdivision, or at 1411 Skyline Drive.
d. Kurt & Joni Lossen - for variance of Section 43.56(e), which requires primary structures to be set back 40 feet from the rear lot line. Petitioner wants to construct an addition on the rear of the house with a 37 foot rear yard setback. Property described as R-1, Lot 17, Block 2, Valley Oaks First Subdivision, or at 214 Oak Leaf Drive.
Notice is sent to the applicants and to the owners of the property affected by the application.
A hearing on these petitions will be given in the Council Chambers, City Hall, Winona, Minnesota at 5:00 p.m. on October 6, 2004 at which time interested persons may appear either in person, in writing, or by agent, and present any reasons which they may have to the granting or denying of these petitions. Any questions regarding the petitioner's request can be directed to the Community Development Department; Inspections Division at 457-8231.
THEY ARE REQUESTED TO PREPARE THEIR CASE IN DETAIL AND PRESENT ALL EVIDENCE RELATING TO THIS PETITION AT THE TIME OF THE SCHEDULED HEARING.
