AN ORDINANCE APPROVING TRANSFER OF LAND FROM THE CITY OF WINONA TO THE PORT AUTHORITY OF WINONA
The City of Winona does ordain:
Section 1. The City of Winona is the owner of certain real property legally described in Exhibit A which is attached hereto and incorporated herein by reference.
EXHIBIT A
That part of the Chicago and North Western Transportation Company (formerly the Chicago Great Western Railway Company) right of way located in Sections Twenty-five (25) and Thirty-six (36), Township One Hundred Seven (107) North, of Range Seven (7), West of the Fifth Principal Meridian, Winona County, Minnesota, described as follows:
Commencing at a point on the Northerly line of Wabasha Street at the Easterly line of Twenty Fifth Street East; thence South 68 degrees 53 minutes East 847.55 feet to the point of beginning; thence North 21 degrees 07 minutes East to the Northerly right of way line of the Chicago and North Western Transportation Company (formerly the Chicago Great Western Railway Company) right of way; thence Southeasterly along the Northeasterly right of way line to the South line of said Section Twenty-five (25); thence West along the South line of said Section Twenty-five (25) to the Westerly right of way line of the Chicago and North Western Transportation Company as located Northerly of the South line of Section Twenty-five (25); thence Northerly along the Westerly right of way line of the Chicago and North Western Transportation Company to the Northerly line of Eighth Street extended Easterly; thence Easterly along the Northerly line of Eighth Street extended Easterly 25 feet; thence Northwesterly along the Southwesterly right of way line of the Chicago and North Western Transportation Company, also being the Northeasterly line of a 25 foot wide strip of said right of way sold to Peerless Chain Company on March 29, 1973, to a point 8.5 feet South 21 degrees 07 minutes West of the point of beginning; thence North 21 degrees 07 minutes East 8.5 feet to the point of beginning.
Section 2. The real property was formerly railroad property and is located adjacent to property owned by Peerless Chain; a depiction of the real property is shown in Exhibit B which is attached hereto and incorporated herein by reference.
Section 3. That the property is marginal property as defined in Minnesota Statutes Section 469.048, subd. 5, in that (a) the land suffers from faulty planning causing deterioration, disuse or economic dislocation and (b) because of lack of use or improper use, the land is stagnant or unproductive and does not contribute to the public health, safety and welfare.
Section 4. That pursuant to Minnesota Statutes Section 469.089, subd. 11, the City shall transfer, without consideration, its interest in the real property described above to the Port Authority of Winona by quit claim deed.
