BOARD OF ADJUSTMENT
NOTICE OF HEARING
PLEASE TAKE NOTICE:
The following applications have been made for variations from the requirements of the Winona City Code, as listed below:
a. Donald J. & Mariann Alsum - for variance of Section 43.53(d), which requires that no building or structure be located closer than 5 feet from any property line. Petitioner's property contains a detached garage which, is located approximately seven feet from the westerly (rear) property line. Petitioners have been approached by representatives of the City Of Winona to acquire the westerly 5 feet of the property in order to facilitate proposed ditch improvements within the adjacent Highway 14 right-of-way. With this, it is requested that the rear yard setback, for the detached garage, be reduced to 1' 0" , as measured from the westerly property line to the wall of the structure. Property described as R-2, Lot 9, Block 1, Hillview Subdivision, or at 505 Kerry Drive.
b. Donald J. & Mariann Alsum - for variance of Section 43.53(d) which requires that no building or structure be located closer than 5 feet from any property line. Petitioner's property contains a detached garage which, is located approximately seven feet from the westerly (rear) property line. Petitioners have been approached by representatives of the City Of Winona to acquire the westerly 5 feet of the property in order to facilitate proposed ditch improvements within the adjacent Highway 14 right-of-way. With this, it is requested that the rear yard setback, for the detached garage, be reduced to 1' 0" as measured from the westerly property line to the wall of the structure. Property described as R-2, Lot 10, Block 1, Hillview Subdivision, or at 513 Kerry Drive.
c. Donald J. & Mariann Alsum - for variance of Section 43.53(d) which requires that no building or structure be located closer than 5 feet from any property line. Petitioner's property contains a detached storage shed which, is located approximately six feet from the westerly (rear) property line. Petitioners have been approached by representatives of the City Of Winona to acquire the westerly 5 feet of the property in order to facilitate proposed ditch improvements within the adjacent Highway 14 right-of-way. With this, it is requested that the rear yard setback, for the detached garage, be reduced to 1' 0" as measured from the westerly property line to the wall of the structure. Property described as R-2, Lot 11, Block 1, Hillview Subdivision, or at 521 Kerry Drive.
d. Donald F. & Betty L. Farnholtz - for variance of Section 43.57(e) which requires a 12 foot minimum side yard setback for four-family two-story, structures located within R-2 zoning districts. Petitioner's property contains one four family two-story residential structure with an approximate 12 foot side yard setback from the westerly property line. Petitioner have been approached by representatives of the City Of Winona to acquire a five foot wide strip of the existing side yard. The purpose of this acquisition would be to facilitate proposed ditch improvements within adjacent Highway 14 right of way. Given that the implementation of this sale will be subject to final field surveys, and given allowances for unforeseen site measurement discrepancies, it is requested that the side yard setback for the existing four family structure be reduced to 5', as measured from the westerly property line to the wall of the structure. Property described as R-2, Lot 12 Block 1, Hillview Subdivision, or at 529 Kerry Drive.
e. Redeemer Lutheran Church - for variance of Section 43.43(k)(5)(ii)(A) which requires that any nonresidential use, which is permitted within a residential zoning district, shall be permitted one on-premis identification sign. Such a sign shall not exceed 64 square feet of total surface area, or 32 square feet of area per sign face, exceed an overall height of five feet, or be located closer than ten feet to any property line. The sign may be indirectly lit, and shall serve to identify only the name and address of the use. Petitioner desires to construct one (two-sided) changeable message ground identification sign on property. As proposed, the sign would include a total surface area of 100 square feet, or 50 square feet of area per sign face, and an overall height of 9 feet 6 inches. Property described as R-3, Par Lot 23 Bk 234 P 262 Ex St, Limits Addition, or at 1664 Kraemer Drive
Notice is sent to the applicants and to the owners of the property affected by the application.
A hearing on these petitions will be given in the Council Chambers, City Hall, Winona, Minnesota at 5:00 p.m. on November 17, 2004 at which time interested persons may appear either in person, in writing, or by agent, and present any reasons which they may have to the granting or denying of these petitions.
