NOTICE OF MORTGAGE FORECLOSURE SALE

NOTICE IS HEREBY GIVEN that default has occurred in the conditions of the following described mortgage:

DATE OF MORTGAGE: January 22, 2004

ORIGINAL PRINCIPAL AMOUNT OF MORTGAGE: $138,750.00

MORTGAGOR(S): James B. Huffman and Carrie R. Huffman, Husband and Wife

MORTGAGEE: Mortgage Electronic Registration Systems, Inc.

DATE AND PLACE OF RECORDING: Recorded January 28, 2004, Winona County Recorder, Document #: 482709

LEGAL DESCRIPTION OF PROPERTY: Commencing on the section line between Sections Twenty-seven (27) and Thirty-four (34) and 13.56 chains West of the section post of Sections Twenty-six (26), Twenty-seven (27), Thirty-four (34) and Thirty-five (35), Township One Hundred Seven (107), Range Seven (7); thence West on said section line 1.57 chains; thence North 21 degrees 10' East, 9.5 chains to Lake Winona; thence Easterly along said Lake 1.54 chains; thence South 21 degrees 35' West, 8.68 chains to the place of beginning, excepting the right of way of the Chicago, Great Western Railroad and excepting also that part conveyed to the City of Winona, lying North of the center of the Public Highway as described in deed recorded in Book 110 of Deeds, page 393, and excepting also the following described parcel: Commencing at a point which is 894.96 feet West of the Southeast corner of said Section Twenty-seven (27), Township One Hundred Seven (107), Range Seven (7); thence North 21 degrees 35' East, a distance of 284.5 feet, as point of beginning; thence North 21 degrees 35' East, a distance of 70 feet to the center of Lake Boulevard; thence Northwesterly along the center line of said Boulevard, a distance of 45 feet; thence South 21 degrees 35' West, a distance of 60 feet; thence South 70 degrees 39' East, a distance of 45 feet to the point of beginning. Said above described land being a part of Lot One (1) of Section Twenty-seven (27), Township One Hundred Seven (107) North, of Range Seven (7), West of the Fifth Principal Meridian, Winona County, Minnesota.

Also commencing at a point where the Westerly line of the above described tract intersects the Southerly line of said Public Highway; thence Southwesterly along the said Westerly line 170 feet; thence Northeasterly to a point on the Southerly line of said Public Highway 10 feet Westerly from said point of beginning; thence Easterly along said Southerly line of said Highway 10 feet to the point of beginning.

COUNTY IN WHICH PROPERTY IS LOCATED: Winona

AMOUNT DUE AND CLAIMED TO BE DUE AS OF DATE OF NOTICE, INCLUDING TAXES, IF ANY, PAID BY MORTGAGEE: $142,086.88

THAT all pre-foreclosure requirements have been complied with; that no action or proceeding has been instituted at law or otherwise to recover the debt secured by said mortgage, or any part thereof;

PURSUANT to the power of sale contained in said mortgage, the above described property will be sold by the Sheriff of said county as follows:

PLACE OF SALE: Sheriff's Main Office, Law Enforcement Center, West Third and Washington, Winona, MN.

to pay the debt secured by said mortgage and taxes, if any, on said premises and the costs and disbursements, including attorneys fees allowed by law, subject to redemption within 6 months from the date of said sale by the mortgagor(s), their personal representatives or assigns.

THIS COMMUNICATION IS FROM A DEBT COLLECTOR ATTEMPTING TO COLLECT A DEBT. ANY INFORMATION OBTAINED WILL BE USED FOR THAT PURPOSE.

THE TIME ALLOWED BY LAW FOR REDEMPTION BY THE MORTGAGOR, THE MORTGAGOR'S PERSONAL REPRESENTATIVES OR ASSIGNS, MAY BE REDUCED TO FIVE WEEKS IF A JUDICIAL ORDER IS ENTERED UNDER MINNESOTA STATUTES, SECTION 582.032, DETERMINING, AMONG OTHER THINGS, THAT THE MORTGAGED PREMISES ARE IMPROVED WITH A RESIDENTIAL DWELLING OF LESS THAN FIVE UNITS, ARE NOT PROPERTY USED IN AGRICULTURAL PRODUCTION, AND ARE ABANDONED.
