AN ORDINANCE TO AMEND
THE CODE OF THE CITY OF
WINONA, MINNESOTA

AN ORDINANCE TO AUTHORIZE ISSUANCE
OF CITATIONS BY WSU PARKING SERVICES
WHEREAS, the City Council, on December 6, 2004, approved a Joint Powers Agreement with the Minnesota State Colleges and Universities Board, for and on behalf of Winona State University, whereby Winona State University (WSU) was authorized to enforce the parking laws pertaining to motor vehicles parked on the city streets located within the Winona State University Campus area, and
WHEREAS, Minnesota Statutes Section 626.862 provides that only a peace officer, constable, or part-time peace officer may issue a citation in lieu of arrest or continued detention unless specifically authorized by ordinance,
NOW, THEREFORE, the City of Winona does ordain:
1. That the WSU Parking Services Department is hereby authorized to issue citations for violations of the parking laws pertaining to motor vehicles parked on the city streets located within the Winona State University Campus area pursuant to the terms of the Joint Powers Agreement approved by the Winona City Council on December 6, 2004.
2. That this ordinance shall take effect upon its publication and shall be effective until December 31, 2007, the date on which the Joint Powers Agreement terminates, or until the earlier termination or cancellation of said Agreement.
