BOARD OF ADJUSTMENT
NOTICE OF HEARING
PLEASE TAKE NOTICE:
The following applications have been made for variations from the requirements of the Winona City Code, as listed below:
a. David Pye - for variance of Section 43.56(e) which requires a minimum side yard setback of 10 feet for a two story dwelling located within an R-1 district. Petitioner desires to construct an addition to home which is located at four feet six inches from side lot line (east side). Property described as R-1, Lot 5, Block 5, Valley Oaks 2nd Subdivision, or at 257 Oak Leaf Drive.
b. Jeff Besek - for variance of Section 43.56(e), which requires primary structures to be set back a minimum 40 foot from the rear lot line. Petitioner wants to construct an addition on the rear of the house with a 34 foot set back from the rear lot line. Property described as R-S, Lot 4, Block 2, Hillview Subdivision, or at 557 Kerry Drive.
c. Tammy Welch - for variance of Section 43.53(d), which requires accessory structures be set back 5 feet from side and rear lot lines. Petitioner wants to have a yard shed with a side yard set back of 2 feet and a rear yard set back of 3 feet. Property described as R-1, Lot 10, Block 2, Habitat 2 Subdivision, or at 701 Jimmy Carter Place.
d. Lora Crofton - for variance of Section 43.53(d), which requires accessory structures be set back 5 feet from side and rear lot lines. Petitioner wants to have a yard shed with a side yard set back of 2 feet and a rear yard set back of 3 feet. Property described as R-1, Lot 8, Block 2, Habitat 2 Subdivision, or at 713 Jimmy Carter Place.
e. Brad Boden - for variance of Section 43.53(d), which requires accessory structures be set back 5 feet from side and rear lot lines. Petitioner wants to have a yard shed with a side yard set back of 2 feet and a rear yard set back of 3 feet. Property described as R-1, Lot 7, Block 2, Habitat 2 Subdivision, or at 719 Jimmy Carter Place.
f. Alycia Lockwood - for variance of Section 43.53(d), which requires accessory structures be set back 5 feet from side and rear lot lines. Petitioner wants to have a yard shed with a side yard set back of 2 feet and a rear yard set back of 3 feet. Property described as R-1, Lot 6, Block 2, Habitat 2 Subdivision, or at 725 Jimmy Carter Place.
g. JoAnna Jones - for variance of Section 43.53(d), which requires accessory structures be set back 5 feet from side and rear lot lines. Petitioner wants to have a yard shed with a side yard set back of 2 feet and a rear yard set back of 3 feet. Property described as R-1, Lot 5, Block 2, Habitat 2 Subdivision, or at 733 Jimmy Carter Place.
h. Rachel Gilligan - for variance of Section 43.53(d), which requires accessory structures be set back 5 feet from side and rear lot lines. Petitioner wants to have a yard shed with a side yard set back of 2 feet and a rear yard set back of 3 feet. Property described as R-1, Lot 4, Block 2, Habitat 2 Subdivision, or at 741 Jimmy Carter Place.
a. Janet Carlson - for variance of Section 43.53(d), which requires accessory structures be set back 5 feet from side and rear lot lines. Petitioner wants to have a yard shed with a side yard set back of 2 feet and a rear yard set back of 3 feet. Property described as R-1, Lot 3, Block 2, Habitat 2 Subdivision, or at 749 Jimmy Carter Place.
b. Marvin DuBois - for variance of Section 43.53(d), which requires accessory structures be set back 5 feet from side and rear lot lines. Petitioner wants to have a yard shed with a side yard set back of 2 feet and a rear yard set back of 3 feet. Property described as R-1, Lot 2, Block 2, Habitat 2 Subdivision, or at 753 Jimmy Carter Place.
c. Larry Hodge - for variance of Section 43.53(d), which requires accessory structures be set back 5 feet from side and rear lot lines. Petitioner wants to have a yard shed with a side yard set back of 2 feet and a rear yard set back of 3 feet. Property described as R-1, Lot 1, Block 2, Habitat 2 Subdivision, or at 759 Jimmy Carter Place.
Notice is sent to the applicants and to the owners of the property affected by the application.
A hearing on these petitions will be given in the Council Chambers, City Hall, Winona, Minnesota at 5:00 p.m. on August 3, 2005 at which time interested persons may appear either in person, in writing, or by agent, and present any reasons which they may have to the granting or denying of these petitions. Any questions regarding the petitioner's request can be directed to the Community Development Department; Inspections Division at 457-8231.
THEY ARE REQUESTED TO PREPARE THEIR CASE IN DETAIL AND PRESENT ALL EVIDENCE RELATING TO THIS PETITION AT THE TIME OF THE SCHEDULED HEARING.
