That the use of the premises is for single family homes newly constructed in compliance with the zoning ordinances of the City of Goodview for D-1 Dwelling Districts as the same exist at the time the building permit is issued and in addition having a single family home with minimum size of at least 1200 square feet, with a garage attached to the dwelling; the garage size is not to be part of the minimum home size. This restriction shall continue in full force and effect for a period of twenty years from the date of this deed.

PARCEL B

Lots Two (2), Three (3), and Four (4), Block One (1) COBRA Subdivision, according to the recorded plat thereof, Winona County, Minnesota,

Subject however to the following restriction:

That the use of the premises is for single family homes constructed in compliance with the zoning ordinances of the City of Goodview for D-1 Dwelling Districts as the same exist at the time the building permit is issued and in addition having a single family home with minimum size of at least 1000 square feet with garage either attached and in addition to the home size or if unattached being of similar appearance to the home, i.e. siding and color, etc. This restriction shall continue in full force and effect for a period of twenty years from the date of this deed.

NOTICE IS FURTHER GIVEN that the object of this action is to obtain a judgment declaring that:

1. Plaintiff GMV Properties, LLC is the owner in fee of the real property above described as Parcel A, and that Lot Two (2), Block One (1) of Volkart's First Addition is subject to a mortgage to Eastwood Bank dated December 6, 2004, recorded in the office of the Winona County Recorded on December 16, 2004, as document #494385, and is also subject to a mortgage to Eastwood Bank dated April 22, 2005, recorded in the office of the Winona County Recorder on April 27, 2005 as document #498313, and that Lot Three (3), Block One (1), Volkart's First Addition is subject to a mortgage to Eastwood Bank dated December 6, 2004, recorded in the office of the Winona County Recorder on December 16, 2004 as document #494386, and is also subject to a mortgage to Eastwood Bank dated June 21, 2005, recorded in the office of the Winona County Recorder on June 24, 2005 as document #500291.

2. Plaintiffs Thomas E. Brandt and Christine E. Brandt are the owners as joint tenants in fee of the real property above described as Parcel B, said Parcel B being subject to a mortgage to Winona National Bank dated November 19, 2004, recorded in the office of the Winona County Recorder on November 23, 2004 as document #493571, also subject to a mortgage to Winona National Bank dated September 24, 2004, recorded in the office of the Winona County Recorder on October 4, 2004 as document #491947.

3. Plaintiffs Joshua J. Wenzel and Tina M. Benedict are owners as joint tenants in fee of the real property above described as Parcel C, said Parcel C being subject to a mortgage to Winona National Bank dated June 14, 2005, recorded in the office of the Winona County Recorder on June 20, 2005, as document #500131.

4. None of the defendants has any right, title, estate, or lien in or upon said real property described as Parcels A, B and C above.

NOTICE IS FURTHER GIVEN that no personal claim is made by plaintiffs against any of the defendants.

The proposed assessment roll is on file for public inspection at the office of the City Clerk. Written or oral objections by a property owner will be considered at the hearing. No appeal may be taken as to the amount of any assessment unless a signed, written objection is filed with the clerk prior to the hearing or presented to the presiding officer at the hearing.

An owner may appeal an assessment to district court pursuant to Minnesota Statutes 429.081 by serving notice of appeal upon the Mayor or City Clerk of the City within 30 days after the adoption of the assessment and filing such notice with the district court within 10 days after service upon the Mayor or City Clerk.

Property owners are also advised of senior citizens hardship special assessment deferral pursuant to Minnesota Statutes 435.193. Persons 65 years of age or older, or retired by virtue of a permanent and total disability, who can demonstrate that payment of the assessment would be a hardship, may make application for deferral. Such application must be filed in the office of the City Clerk.

The City has established a department procedure pursuant to Minnesota Statutes 435.193 through 435.195.

The total combined amount of the proposed assessment(s) for all of the properties listed on the attached Exhibit A is: $92,465.76.

The contractor shall furnish the owner, within ten (10) days after the contract is awarded, a bond executed by a surety company approved by the owner in the full amount of the contract and conditioned as provided by the General Statues of the State. ORDINANCE 3653

AN ORDINANCE TO AMEND

THE CITY CODE OF

WINONA, MINNESOTA

1979

The City of Winona does ordain:

Section 1. That paragraph (e) of Section 22.22 of the City Code of Winona, Minnesota, 1979, which section is entitled "Unfair Discriminatory Practices in the City", be amended as follows:

"(e)        Unfair Discriminatory Practices in the City. (a)   Adoption of State Unfair Discriminatory Practices Relating to Real Property. Section 363.A.09 of Minnesota Statutes, as amended, is hereby incorporated by reference into this Chapter. (Real Estate.   It is an unfair discriminatory practice:

[1]  For an owner, lessee, sublessee, assignee, or managing agent of, or other person having the right to sell, rent or lease any real property, or any agent of any of these:

a. To refuse to sell, rent, or lease or otherwise deny to or withhold from any person or group of persons any real property because of race, color, creed, religion, national origin, sex, marital status, status with regard to public assistance or disability, student status if the student is of majority age;

b. To discriminate against any person or group of persons because of race, color, creed, religion, national origin, sex, marital status, status with regard to public assistance or disability, student status if the student is of majority age, in the terms, conditions or privileges of the sale, rental or lease of any real property or in the furnishing of facilities or services in connection therewith; or

c. In any transaction involving real property, to print, circulate or post or cause to be printed, circulated, or posted any advertisement or sign, or use any form of application for the purchase, rental or lease of real property, or make any record or inquiry in connection with the prospective purchase, rental or lease of real property which expresses, directly or indirectly any limitation, specification, or discrimination as to race, color, creed, religion, national origin, sex, marital status, status with regard to public assistance or disability, student status if the student is of majority age, or any intent to make any such limitation, specification, or discrimination.

[2]   For a real estate broker, real estate salesman, or employee, or agent thereof:

a. To print, circulate, or post or cause to be printed, circulated, or posted any advertisement or sign, or use any form of application for the purchase, rental, or lease of any real property or make any record or inquiry in connection with the prospective purchase, rental or lease of any real property, which expresses directly or indirectly, any limitation, specification or discrimination as to race, color, creed, religion, national origin, sex, marital status, status with regard to public assistance or disability, student status if the student is of majority age, or any intent to make any such limitation, specification or discrimination.

[3] For a person, bank, banking organization, mortgage company, insurance company, or other financial institution or lender to whom application is made for financial assistance for the purchase, lease, acquisition, construction, rehabilitation, repair or maintenance of any real property or any agent or employee thereof:

To discriminate against any person or group of persons because of race, color, creed, religion, national origin, sex, marital status, status with regard to public assistance or disability, student status if student is of majority age, of the person or group of persons or of the prospective occupants or tenants of such real property in the granting, withholding, extending, modifying or renewing, or in the rates, terms, conditions, or privileges of the financial assistance or in the extension of services in connection therewith; or

b. To use any form of application for such financial assistance or make any record or inquiry in connection with applications for such financial assistance which expresses, directly or indirectly, any limitation, specification, or discrimination as to race, color, creed, religion, national origin, sex, marital status, status with regard to public assistance or disability, student status if the student is of majority age, or any intent to make any such limitation, specification, or discrimination; or

c. To discriminate against any person or group of persons who desire to purchase, lease, acquire, construct, rehabilitate, repair or maintain real property solely because of the social, economic or environmental conditions of the area in the granting, withholding, extending, modifying, or renewing, or in the rates, terms, conditions, or privileges of any such financial assistance or in the extension of services in connection therewith.

(b) Violation of any provision hereunder shall constitute a misdemeanor."

Section 3. That this ordinance shall take effect upon its publication.

ORDINANCE 3654

AN ORDINANCE TO AMEND

THE CITY CODE OF

WINONA, MINNESOTA

1979

The City of Winona does ordain:

Section 1. That paragraph (72) of Chapter 51 of the City Code of Winona, Minnesota, which paragraph is entitled "Request for copies of government data" be amended to read as follows:

"(72) Request for copies of government data:

For 100 or fewer pages:

" Black and white copies, letter or legal size:

No charge for 10 pages or less

Over 10 pages - 20 cents per page including the first 10 pages

Double sided copies are 20 cents per side

" Color copies, letter or legal size:

No charge for 10 pages or less

Over 10 pages - 25 cents per page including the first 10 pages

" Special sized copies will be charged at cost.

In all other circumstances, in addition to the above costs, actual costs for searching for and retrieving the data, including the cost of employee time, and for making, certifying, compiling and electronically transmitting copies shall be charged as follows:

Employee Time

" Requests requiring more than 30 minutes of employee time to search for and retrieve documents will be charged $17.00 per hour, charged in increments of 1/4 hour. This rate is based on the current salary schedule for secretaries.

In special circumstances, where business necessity of the department requires that a higher-grade employee fill the request for data, that employee's actual hourly rate will be charged.

" Manipulated data = $20.00 per hour: The charge for manipulated data will be charged at an hourly rate of $20.00, pro rated in 1/4 hour increments.

Certifications = $5.00: The current fee for certifying copies is $5.00 each in addition to the copying or other associated charges, if any.

Mailing = actual costs: The mailing fee will reflect the actual cost of mailing, including postage, envelopes and labels. There is no fee for e-mail transmittal of data, except that the hourly employee time will be charged when searching for and retrieving data that takes more than 1/2 hour.

Computer disks = $10.00: The fee for disks is $10.00 per diskette of data.

Audiotapes = $15.00: The fee for an audiocassette is $15.00 per dubbed tape.

Videotapes = $20.00: The fee for a videotape is $20.00 per dubbed tape."

Section 2. That this ordinance shall take effect upon its publication.
